Although the construction business can be tough and construction workers have their work cut out for them every day, keeping construction sites safe is easy when you follow a plan.
While keeping that in mind, it’s important to note that Local Law 81, a new construction law in New York City, states that any construction job requiring a superintendent also requires a Site Safety Plan. It is mandatory! The new law went into effect on Nov. 6, 2017, and amends the NYC Construction Code.
Accordingly, construction companies don’t want to take any risks, or they could face violations, fines, stop work orders and/or project delays.
Take note and be advised of Site Safety Plans that will be required for the following in NYC:
- New building construction or demolition (excluding 1-, 2- and 3-family homes)
- Vertical or horizontal enlargement
- Any job for which special inspections are required for underpinning or protection of sides of excavations
- Removal of one or more floors over a 12-month period
- Alteration or demolition of more than 50 percent of the floor area of a building over a 12-month period
With the new law in effect, it is also mandatory that Site Safety Plans are kept on the job site at all times and are readily available to the Department of Buildings (DOB) upon request. The Site Safety Plan must be maintained until all work at the site is complete and signed off.
Additionally, the new law formalizes the duties, roles and responsibilities of the construction superintendent and mandates the designation of competent persons.
